Terms of Service

These Terms of Service (“Terms”) govern your use of the Elevated Mom Co website, The Nudge membership, SMS messages, digital resources, and related services. By using our services or completing a purchase, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to enter into a binding agreement to purchase or use our paid membership services.

2. The Nudge Membership

The Nudge is a recurring membership designed to provide timely reminders, seasonal prompts, action-guide links, and related resources. The exact content, delivery schedule, and message frequency may vary by season and membership needs.

3. Membership, Pricing & Billing

The Nudge is offered as a recurring monthly membership. Unless otherwise stated at checkout, memberships renew automatically until canceled.

Founding Member Pricing. Founding members receive access to The Nudge at $7.99 per month for as long as their membership remains continuously active. This pricing is available only while membership remains active and in good standing. If a membership is canceled, whether voluntarily or due to non-payment (see Payment & Grace Period below), the founding-member rate will be forfeited. Any future membership will be billed at the then-current public membership rate.

4. Payment & Grace Period

If a scheduled membership payment is unsuccessful, your membership will enter a 7-day grace period.

• Your membership remains active.
• Your access to member resources continues.
• Your founding-member pricing (if applicable) remains protected while payment is resolved.

If payment is not successfully completed within the 7-day grace period, your membership will automatically be canceled. Upon cancellation, any founding-member pricing will be permanently forfeited. Rejoining later will be at the then-current public membership rate.

5. Cancellations & Refunds

Cancellations. You may cancel your membership at any time through your Stan Store account. Cancellation becomes effective at the end of your current billing period. You will continue to have access until that billing period ends.

Refund Policy. Because members receive immediate access to digital content and membership benefits, membership fees are non-refundable. Refunds are not provided for partial billing periods, unused time, or failure to cancel before renewal.

6. SMS Program Terms

• Program name: Elevated Mom Co — The Nudge.
• Message content: Membership reminders, seasonal prompts, notifications, action-guide links, and related service information.
• Frequency: Message frequency varies.
• Cost: Elevated Mom Co does not charge a separate SMS fee, but message and data rates may apply through your carrier.
• Opt-out: Reply STOP to cancel. After opting out, you may receive a confirmation message.
• Help: Reply HELP or email info@elevatedmomco.com.
• Carriers: Wireless carriers are not liable for delayed or undelivered messages.
• Consent: Consent to receive SMS messages is voluntary. Where legally required, consent is not a condition of purchasing unrelated goods or services.

You represent that you are the subscriber or customary user of the mobile number provided and agree to notify us if that number changes or is reassigned.

7. Digital Products and Resources

Digital guides, checklists, templates, and other resources are provided for personal, noncommercial use unless we expressly state otherwise. You may not reproduce, resell, distribute, publish, or commercially exploit them without written permission.

8. Shop Purchases

Physical products may be sold through Etsy or another third-party marketplace. Product fulfillment, shipping, returns, exchanges, and marketplace payments may also be subject to that platform’s terms and the policies shown in the applicable listing.

9. Informational Purpose

Our reminders and resources are provided for general organizational and lifestyle purposes. They are not medical, legal, financial, educational, or other professional advice. You remain responsible for confirming school, event, retailer, travel, and other deadlines with the relevant organization.

10. Availability and Changes

We may modify, suspend, or discontinue portions of the services, features, schedules, or resources. We do not guarantee uninterrupted or error-free access, or that every message will be delivered at a particular time.

11. Acceptable Use

You may not misuse the website or services, interfere with their operation, attempt unauthorized access, use them unlawfully, or infringe the rights of Elevated Mom Co or others.

12. Intellectual Property

The names Elevated Mom Co, The Nudge, Present Over Perfect, together with the text, graphics, designs, digital resources, and branding associated with our services, are owned by or licensed to Elevated Mom Co. and are protected by applicable intellectual-property laws.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the services are provided “as is” and “as available” without warranties of any kind, whether express or implied.

14. Limitation of Liability

To the fullest extent permitted by law, Elevated Mom Co will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the services. Any liability that cannot lawfully be excluded will be limited to the amount you paid to Elevated Mom Co for the applicable service during the three months before the event giving rise to the claim.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.

16. Changes to These Terms

We may update these Terms periodically. Continued use after an update means you accept the revised Terms to the extent permitted by law.
